Terms and Conditions
Authorization.
The client agrees to engage Body-Fix Health & Fitness, a sole proprietor as an independent contractor for the sole specific purpose of health and fitness personal training and Sports Therapy. This agreement excludes personal or lifestyle advice that is not connected with health and fitness.
Services.
Body-Fix Health & Fitness agrees to provide one-to-one personal health and fitness training and/or Sports therapy treatment based on the information gathered on the Pre activity Health/medical Screening form, any additional verbal information.
Information.
The client agrees to supply Body-Fix Health & Fitness with health and fitness related information to enable safe and effective activity sessions to be designed and undertaken. The client further agrees to advise their instructor of any changes in that information that may affect the activity sessions.
Risk.
Any exercise program carries with it an element of risk. The activity sessions will be designed to minimize the risks whilst providing an effective cardiovascular or resistance workout. The client agrees to inform the instructor if for any reason (such as illness or injury which might be aggravated by exercise, undue pain or excessive discomfort) they should not participate in an activity. The client is free to withdraw from any activity at any time.
Payment of Fees.
Fees to Body-Fix Health & Fitness are due and payable as per the current price plan. They may be paid monthly by standing order or by full payment for and upon each agreed activity session, or in the case of a periodized program only, upon receipt of the program. All payments must be made in UK Pounds Sterling (GBP).
Overdue Fees.
In order for Body-Fix Health & Fitness to remain in business, payments must be made promptly. Overdue fees of 15 days after their due date will incur an additional 5% penalty added to the total invoice amount and for each month of non-payment thereafter. Body-Fix Health & Fitness reserves the right to withdraw from further activity sessions until final payment is made. In case collection proves necessary, the client agrees to pay all fees incurred by that process.
Deposit Payment and Refund Policy.
This agreement begins with a deposit payment as agreed on signing. If the client halts work and applies by registered letter for a refund within 30 days, to Body-Fix Health & Fitness, any work completed shall be billed at the hourly rate of GBP 30, and deducted from the initial payment, the balance of which shall be returned to the client. If, at the time of the request for refund, work has been completed beyond the amount covered by the initial payment, the client shall be liable to pay for all work completed at the hourly rate stated above. No portion of this initial payment will be refunded unless written application is made within 30 days of signing this contract.
Cancellation of Activity Session.
The client agrees to give at least 24 hours notice of the cancellation of an activity session via telephone. In the event of notice being received in less than 24 hours, a minimum GBP 15 cancellation fee will be applied. Cancellations of less than 2 hours notice will be charged at the full rate.
Sole Agreement.
The agreement contained in this ‘Client Agreement’ constitutes the sole agreement between Body-Fix Health & Fitness and the client regarding health and fitness personal training or sports therapy. All prices specified in this agreement will be honored for the agreed number of activity sessions or period of program after both parties sign the initial health screening form by means of an agreement.
Legal.
This agreement was entered into under laws governing England and any dispute will be litigated or arbitrated in England and Wales. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
